A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a voting system requirement that a person voting by |
|
personal appearance confirm the voter's eligibility to vote before |
|
accessing a ballot. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 122, Election Code, is |
|
amended by adding Section 122.0015 to read as follows: |
|
Sec. 122.0015. VOTING SYSTEM STANDARDS: CONFIRMATION OF |
|
ELIGIBILITY. (a) A voting system may not be used in an election |
|
unless the voting system requires a person seeking to vote by |
|
personal appearance, before the person may access the ballot, to |
|
confirm that the person: |
|
(1) is a United States citizen; |
|
(2) is a resident of the county in which the person |
|
seeks to vote; |
|
(3) has not been determined by a final judgment of a |
|
court exercising probate jurisdiction to be: |
|
(A) totally mentally incapacitated; or |
|
(B) partially mentally incapacitated without the |
|
right to vote; and |
|
(4) has not been finally convicted of a felony or, if |
|
so convicted, has: |
|
(A) fully discharged the person's sentence, |
|
including any term of incarceration, parole, or supervision, or |
|
completed a period of probation ordered by any court; or |
|
(B) been pardoned or otherwise released from the |
|
resulting disability to vote. |
|
(b) The confirmation required under Subsection (a) may be |
|
completed by the person seeking to vote in one motion or gesture. |
|
(c) A person seeking to vote may request assistance from an |
|
election officer if the person: |
|
(1) has questions about the confirmation; or |
|
(2) determines that the person is unable to complete |
|
the confirmation. |
|
(d) The secretary of state shall adopt rules to implement |
|
this section. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect on the 91st day after the last day of the |
|
legislative session. |
