BACKGROUND AND PURPOSE
The County of El Paso has requested a change in statute to authorize the county to allow a county employee to voluntarily donate unused vacation leave time to a county sick leave pool. That authorization is currently limited to counties with larger populations. H.B. 180 seeks to address this issue by decreasing the minimum county population that triggers such authorization, thereby allowing El Paso County to provide that benefit to its employees.

CRIMINAL JUSTICE IMPACT
It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 180 amends the Local Government Code to decrease from one million to 800,000 the minimum population of a county whose commissioners court may allow an applicable employee to voluntarily transfer vacation leave time earned by the employee to a county sick leave pool.

EFFECTIVE DATE
On passage, or, if the bill does not receive the necessary vote, September 1, 2021.
