AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1456 repeals the sunset date of the Nueces County LPPF.

 

H.B. 1456 amends current law relating to the operations of the Nueces County Hospital District, including the operations of a health care provider participation program administered by the district.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends the heading to Section 281.094, Health and Safety Code, to read as follows:

 

Sec. 281.094.� USE OF FUNDS BY THE NUECES COUNTY HOSPITAL DISTRICT.

 

SECTION 2. Amends Section 281.094(a), Health and Safety Code, as follows:

 

(a) Authorizes the board of hospital managers (board) of the Nueces County Hospital District (district) to use funds made available to the district from any source, rather than from sources other than a tax levy, to fund health care services for residents of the district, including public health services, mental health and intellectual disability services, emergency medical services, health services provided to persons confined in jail facilities, and for other health related purposes if the board determines the district has funds available that are in addition to the funds necessary to satisfy the district's obligation to fund indigent health care for residents of the district and the Nueces County Commissioners Court approves of the board's use of the funds. Makes nonsubstantive changes.

 

SECTION 3. Repealer: Section 298C.004 (Expiration), Health and Safety Code, as added by Chapter 694 (S.B. 2315), Acts of the 86th Legislature, Regular Session, 2019.

 

SECTION 4. Repealer: Section 2, Chapter 694 (S.B. 2315), Acts of the 86th Legislature, Regular Session, 2019.

 

SECTION 5. Provides that, to the extent of any conflict, this Act prevails over another Act of the 87th Legislature, Regular Session, 2021, relating to nonsubstantive additions to and corrections in enacted codes.

 

SECTION 6. Effective date: upon passage or September 1, 2021.
