BACKGROUND AND PURPOSE

The City of Mission needs statutory authority to establish a new cemetery within city limits. C.S.H.B. 1571 seeks to provide for this authority by exempting certain cemeteries in the city from cemetery location restrictions.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

C.S.H.B. 1571 amends the Health and Safety Code to exempt from certain cemetery location restrictions a cemetery established and operating before September 1, 2021, in a municipality that has a state veterans cemetery and a population of not less than 75,000 and not more than 95,000.

EFFECTIVE DATE

September 1, 2021.

While C.S.H.B. 1571 may differ from the original in minor or nonsubstantive ways, the following summarizes the substantial differences between the introduced and committee substitute versions of the bill.

The substitute does not remove language from the exemption for cemeteries established and operated by an organized religious society or sect.
