AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The selection of the Texas state musician has allowed the state legislature to recognize the outstanding contributions made by the state's amazing artists. Unfortunately, although numerous classical musicians have been nominated for designation as the Texas state musician, including many with international recognition, it has been difficult for them to compete with the likes of Willie Nelson, Lyle Lovett, and George Strait. H.B. 2139 seeks to address this issue by providing for a Texas state musician for the classical genre and a Texas state musician for the nonclassical genre.

 

H.B. 2139 amends the Government Code to split the designation of the Texas state musician into two designations as follows:

 

 

H.B. 2139 amends current law relating to the designation of state musicians for classical and nonclassical genres.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 3104.002, Government Code, as follows:

Sec. 3104.002.  New heading: DESIGNATING POET LAUREATE, STATE MUSICIANS, AND STATE ARTISTS. (a) Requires the Texas Poet Laureate, State Musician, and State Artist Committee (committee) to designate:

(1) makes no changes to this subdivision;

(2) a Texas state musician for the classical genre, rather than a Texas state musician;

(3) a Texas state musician for the nonclassical genre;

(4) and (5) makes nonsubstantive changes to these subdivisions.

(b) Makes a conforming change to this subsection.

SECTION 2. Amends the heading to Chapter 3104, Government Code, to read as follows:

CHAPTER 3104.� POET LAUREATE, STATE MUSICIANS, STATE HISTORIAN, AND STATE ARTISTS

SECTION 3.  Amends the heading to Subchapter A, Chapter 3104, Government Code, to read as follows:

SUBCHAPTER A. POET LAUREATE, STATE MUSICIANS, AND STATE ARTISTS

SECTION 4. Amends Sections 3104.004(a) and (c), Government Code, to make conforming changes.

SECTION 5. Amends Section 3104.005, Government Code, to make a conforming change.

SECTION 6. Amends  Section 3104.006, Government Code, to make a conforming change.

SECTION 7. Amends Section 3104.007, Government Code, to make a conforming change.

SECTION 8.  Effective date: September 1, 2021.
