BACKGROUND AND PURPOSE

 

Under current law, retail fireworks permit holders must close all firework sales and turn away customers exactly at midnight on July 4 for the Independence Day fireworks season. Concerns have been raised that turning away customers who are already waiting in line to purchase fireworks at midnight is unfair to both the customers and the permit holders. H.B. 2569 seeks to address this issue by extending the period during which a permit holder may sell fireworks for the Independence Day fireworks season.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 2569 amends the Occupations Code to extend from midnight on July 4 to midnight on July 5 the ending time of the period that begins June 24 during which a retail fireworks permit holder may sell fireworks to the public.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2021.
