AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Professional Sports Team Charitable Foundation Raffle Enabling Act authorizes qualifying professional sports team charitable foundations to conduct charitable raffles to raise money for the foundation's charitable purposes. These charitable foundations support causes such as after-school health and fitness programs, community service initiatives, and youth scholarships.

 

Given that these charitable raffles have proven to be instrumental in generating revenue in support of these important charitable purposes, there have been calls for the legislature to allow more foundations to conduct these raffles. H.B. 3012 seeks to answer these calls and include an organization sanctioned by the Professional Rodeo Cowboys Association among those qualified to conduct charitable raffles.

 

H.B. 3012 amends current law relating to charitable raffles conducted by the professional sports teams charitable foundations of organizations sanctioned by certain professional associations at rodeo venues.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 2004.002, Occupations Code, by amending Subdivision (2) and adding Subdivisions (5) and (6), as follows:

 

(2) Redefines "professional sports team," for purposes of Chapter 2004 (Professional Sports Team Charitable Foundation Raffles), to include an organization sanctioned by the Professional Rodeo Cowboys Association or the Women's Professional Rodeo Association. Makes a nonsubstantive change.

 

(5) Defines "rodeo event" for purposes of Chapter 2004.

 

(6) Defines "rodeo venue" for purposes of Chapter 2004.

 

SECTION 2. Amends Section 2004.003, Occupations Code, to provide that a professional sports team charitable foundation is qualified to conduct charitable raffles under Chapter 2004 if the foundation is associated with a professional sports team with a home venue or rodeo venue located in this state.

 

SECTION 3. Amends Section 2004.004(a), Occupations Code, to authorize a professional sports team charitable foundation that meets the qualifications under Section 2004.003 (Qualifications to Conduct Raffle) to conduct a charitable raffle during each preseason, regular season, and postseason game hosted at the home venue or each rodeo event at the rodeo venue of the professional sports team associated with the foundation to provide revenue for the foundation's charitable purposes.

 

SECTION 4. Effective date: December 1, 2021, contingent upon approval by the voters of the constitutional amendment relating to authorizing the professional sports team charitable foundations of organizations sanctioned by the Professional Rodeo Cowboys Association or the Women's Professional Rodeo Association to conduct charitable raffles at rodeo venues.
