BACKGROUND AND PURPOSE

 

Local military leaders have advocated that a partnership between the Texas Department of Transportation (TxDOT) and the U.S. Department of Defense (DOD) for transportation projects located on federal military property would lead to cost savings and provide numerous benefits to Texas motorists. H.B. 3399 seeks to facilitate this by authorizing TxDOT to enter into an agreement with DOD to allow TxDOT to assist with the provision of certain road services.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3399 amends the Transportation Code to authorize the Texas Department of Transportation (TxDOT) to enter into an agreement with the U.S. Department of Defense or another federal entity to allow TxDOT to assist with the provision of road maintenance, improvement, relocation, or extension services for military installations. The bill prohibits the use of state funds to provide services under such an agreement and prohibits TxDOT from entering into such an agreement if payment for the services provided under the agreement would be made from federal funds provided to the state for public roads.
