AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
During the 2019 session, the legislature enacted legislation to create an efficient, effective regulatory framework for travel insurance. As part of that effort, the legislature required the Comptroller of Public Accounts of the State of Texas to consult with the commissioner of insurance to adopt rules for that purpose. Since the legislation was enacted, however, it has been suggested that this requirement creates an unnecessary administrative burden for both agencies. H.B. 3618 removes the requirement.
H.B. 3618 amends current law relating to the comptroller's rulemaking authority under the Insurance Code.
RULEMAKING AUTHORITY
Rulemaking authority previously granted to the Comptroller of Public Accounts the State of Texas is modified in SECTION 1 (Section 3504.0007, Insurance Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 3504.0007(b), Insurance Code, to delete existing text requiring the Comptroller of Public Accounts of the State of Texas to consult with the commissioner of insurance in adopting rules to implement Chapter 3504 (Travel Insurance).
SECTION 2. Effective date: September 1, 2021.
