BACKGROUND AND PURPOSE

Texas, which hosts nearly 100,000 children of military families, adopted the Interstate Compact on Educational Opportunity for Military Children to become part of the national effort to address key educational transition issues for children in military families. However, concerns have been raised regarding the operation, execution, and facilitation of the compact and the need to more effectively accomplish its goals of providing support for children who live and learn in Texas. H.B. 3932 seeks to address these concerns by providing for the establishment of a state advisory council.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 3932 amends the Education Code to require the compact commissioner of the interstate compact on educational opportunity for military children, in coordination with the Texas Education Agency (TEA), to establish the state advisory council on educational opportunity for military children to provide for coordination among state agencies, public school districts, and military installations concerning state participation in and compliance with the compact and compact activities. The bill establishes the membership of the council and provides for required council functions, policies and procedures, documentation, voting, and meetings, including authorizing meetings to be conducted face-to-face or by means of telecommunication or electronic communication. The bill establishes that the council is a governmental body for purposes of state open meetings law.

H.B. 3932 repeals Section 162.005, Education Code, which requires TEA to provide coordination concerning state participation in and compliance with the compact and compact activities.
