BACKGROUND AND PURPOSE

 

Concerns have been raised regarding the operation of commercial motor vehicles in the city of Cleburne. It has been noted that police officers in Cleburne do not have the authority to enforce commercial motor vehicle standards, which creates safety risks for all motorists in the city. H.B. 4087 seeks to remedy this situation by making Cleburne police officers eligible to apply for certification to enforce these standards.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 4087 amends the Transportation Code to make a police officer of a municipality that meets the following criteria eligible to apply for certification to enforce commercial motor vehicle safety standards:

·         the municipality has a population of more than 25,000 and less than 50,000;

·         the municipality is located in a county with a population of more than 150,000 and less than 200,000; and

·         the municipality contains a toll project of a regional tollway authority and a highway that is part of the national system of interstate and defense highways.

 

EFFECTIVE DATE

 

September 1, 2021.
