AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Health and Human Services Commission has access to certain criminal history record information, but lacks explicit authorization to access criminal history information contained in the juvenile justice information system. H.B. 4158 seeks to remedy this situation by clarifying this authority.

 

H.B. 4158 amends current law relating to the dissemination of confidential information contained in the juvenile justice information system.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 58.106(a), Family Code, to provide that, except as otherwise provided by Section 58.106 (Dissemination of Confidential Information in Juvenile Justice Information System), information contained in the juvenile justice information system is confidential information for the use of the Department of Public Safety of the State of Texas (DPS) and is prohibited from being disseminated by DPS except to the Department of Family and Protective Services or the Health and Human Services Commission as provided by Section 411.114 (Access to Criminal History Record Information: Department of Family and Protective Services and Health and Human Services Commission), Government Code.

 

SECTION 2. Effective date: upon passage or September 1, 2021.
