AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 4356 amends current law relating to the qualifications of directors of certain municipal development districts.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 377.051(e), Local Government Code, as follows:

 

(e) Authorizes a person, notwithstanding Subsection (d) (relating to requiring a person, to qualify to serve as a director, to reside in the municipality that created the district or in that municipality's extraterritorial jurisdiction), to qualify to serve as a director of a district if the person resides in the independent school district that serves the majority of the district and the district is located in a municipality:

 

(1) creates this subdivision from existing text and makes a nonsubstantive change; or

 

(2) with a population of more than 1,488 and less than 2,500 and that is located wholly in a county with a population of more than 20,000 and less than 30,000 that borders the Neches River and the Trinity River, rather than if the person resides in the independent school district that serves the majority of the district.

 

Deletes existing text authorizing a person to qualify to serve as a director of a district is a located in a municipality if the person resides in the independent school district that serves the majority of the district.

 

SECTION 2. Effective date: upon passage or September 1, 2021. �
