BACKGROUND AND PURPOSE

 

The City of Conroe Municipal Management District No. 3 was created by the Texas Legislature in 2019. There have been calls for the City of Conroe to annex the territory of the district into its corporate limits, but there are concerns about the city assuming the district's outstanding debt and obligations upon doing so. H.B. 4573 seeks to provide that the district is not dissolved and retains all of its own outstanding debt and obligations upon annexation by the city.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 4573 amends the Special District Local Laws Code to establish that, if any or all of the territory of the City of Conroe Municipal Management District No. 3 is annexed by the City of Conroe into the city's corporate limits, the district retains all of its outstanding debt and obligations and is not dissolved.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2021.
