BACKGROUND AND PURPOSE

 

There have been calls for the City of Roman Forest to annex the territory of the Roman Forest Public Utility District No. 3 into its corporate limits, but there are concerns about the city having to assume the district's outstanding debt and obligations upon doing so. H.B. 4574 seeks to provide that upon annexation of the district by the city, the district retains all of its outstanding debt and obligations and is not dissolved.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 4574 amends the Special District Local Laws Code to establish that, if all or any part of the territory of the Roman Forest Public Utility District No. 3 is annexed by the City of Roman Forest into the city's corporate limits, the district retains all of its outstanding debt and obligations and is not dissolved.

On passage, or, if the bill does not receive the necessary vote, September 1, 2021.
