AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

Currently, under Section 1701.260(g), Occupations Code, school marshal licenses expire: "�the first birthday of the person occurring after the second anniversary of the date the commission licenses the person." This has made it far more difficult to keep track of than a unified expiration date. S.B. 785 would make all school marshals licenses expire on August 31 occurring after the second anniversary of licensure to create a unified expiration date.

S.B. 785 amends current law relating to the expiration of a school marshal license issued or renewed by the Texas Commission on Law Enforcement.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 1701.260(g), Occupations Code, as follows:

(g) Provides that a person's license under Section 1701.260 (Training for Holders of License to Carry a Handgun; Certification of Eligibility for Appointment as School Marshal) expires on August 31 following, rather than on the first birthday of the person occurring after, the second anniversary of the date the Texas Commission on Law Enforcement licenses the person. Provides that a renewed school marshal license expires on August 31, rather than on the person's birth date, two years after the expiration of the previous license.

SECTION 2. Provides that Section 1701.260(g), Occupations Code, as amended by this Act, applies to a license issued or renewed under that section regardless of whether the license was issued or renewed before, on, or after the effective date of this Act.

SECTION 3. Effective date: September 1, 2021.
