AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Cottonwood Creek Water Control and Improvement District No. 3 (district) was created under the general law, and the creation has been confirmed. The district is located within western Bastrop County, approximately 10 miles south of the City of Elgin and 9 miles west of the City of Bastrop. No infrastructure has been developed within the district�s boundaries.

 

Passage of this bill will allow the district to provide the public financing and ownership needed for the development of Greenport International Technology Campus and Greenport International Airport. In addition to the powers granted under the general law relating to water, sewer, and drainage, the bill provides the district additional powers to finance, operate, and own roadways, airport-related facilities, and other related infrastructure needed to enhance the transportation and utility infrastructure of the state and region and to develop and diversify the economy of the State of Texas and the region.

 

This bill also adds three tracts of land located within Bastrop County to the district�s boundaries.

 

As proposed, S.B. 2225 amends current law relating to the Cottonwood Creek Development District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Provides that the district created by Travis County as the Cottonwood Creek Water Control and Improvement District No. 3 is renamed the Cottonwood Creek Development District (district).

 

SECTION 2. Amends Subtitle X, Title 6, Special District Local Laws Code, by adding Chapter 11016, as follows:

 

CHAPTER 11016. COTTONWOOD CREEK DEVELOPMENT DISTRICT

 

Sets forth standard language for the creation of the district. Sets forth standards, procedures, requirements, and criteria for:

 

General provisions, including the nature and public purpose of the district, territory added to the district, and eligibility for inclusion in special zones (Sections 11016.0101-11016.0108);

 

Powers and duties of the district, including adding or removing territory (Sections 11016.0201-11016.0221);

 

General financial provisions, including the authority to impose certain taxes and issue bonds (Sections 11016.0301-11016.0505);

 

Creation of nonprofit corporations, powers and duties and general financial provisions of nonprofit corporations, and oversight of nonprofit corporations (Sections 11016.0601-11016.0607); and

 

Division of the district, including elections for the division of districts and of directors of new districts (Sections 11016.0701-11016.0705).

 

SECTION 3. Sets forth the initial and added boundaries of the district.

 

SECTION 4. Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 5. Effective date: upon passage or September 1, 2021.
