A BILL TO BE ENTITLED
 
AN ACT
  relating to voting outside a polling place.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Section 64.009, Election Code, is
  amended to read as follows:
         Sec. 64.009.  VOTING OUTSIDE [VOTER UNABLE TO ENTER] POLLING
  PLACE.
         SECTION 2.  Section 64.009(a), Election Code, is amended to
  read as follows:
         (a)  On [If a voter is physically unable to enter the polling
  place without personal assistance or likelihood of injuring the
  voter's health, on] the voter's request, an election officer shall
  deliver a ballot to the voter at the polling place entrance or curb
  if a voter is:
               (1)  physically unable to enter the polling place
  without personal assistance or likelihood of injuring the voter's
  health; or
               (2)  a parent or legal guardian accompanied by the
  parent's or legal guardian's child.
         SECTION 3.  The heading to Section 85.034, Election Code, is
  amended to read as follows:
         Sec. 85.034.  VOTING OUTSIDE [VOTER UNABLE TO ENTER] POLLING
  PLACE.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
