A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to voting outside a polling place. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Section 64.009, Election Code, is |
|
|
amended to read as follows: |
|
|
Sec. 64.009. VOTING OUTSIDE [VOTER UNABLE TO ENTER] POLLING |
|
|
PLACE. |
|
|
SECTION 2. Section 64.009(a), Election Code, is amended to |
|
|
read as follows: |
|
|
(a) On [If a voter is physically unable to enter the polling |
|
|
place without personal assistance or likelihood of injuring the |
|
|
voter's health, on] the voter's request, an election officer shall |
|
|
deliver a ballot to the voter at the polling place entrance or curb |
|
|
if a voter is: |
|
|
(1) physically unable to enter the polling place |
|
|
without personal assistance or likelihood of injuring the voter's |
|
|
health; or |
|
|
(2) a parent or legal guardian accompanied by the |
|
|
parent's or legal guardian's child. |
|
|
SECTION 3. The heading to Section 85.034, Election Code, is |
|
|
amended to read as follows: |
|
|
Sec. 85.034. VOTING OUTSIDE [VOTER UNABLE TO ENTER] POLLING |
|
|
PLACE. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
