A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of the Texas Commission on Environmental |
|
Quality to require water pollution abatement plans from certain |
|
facilities regulated by the Railroad Commission of Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
|
by adding Section 26.0462 to read as follows: |
|
Sec. 26.0462. EDWARDS AQUIFER PLANS ASSOCIATED WITH OIL, |
|
GAS, OR GEOTHERMAL RESOURCES. Notwithstanding another provision of |
|
this chapter or a provision of the Natural Resources Code, the |
|
commission may require the owner or operator of a facility used in |
|
connection with an activity that is associated with the |
|
exploration, development, or production of oil, gas, or geothermal |
|
resources and regulated by the Railroad Commission of Texas to |
|
submit to the commission a water pollution abatement plan for the |
|
facility if the facility is located in the recharge zone of the |
|
Edwards Aquifer, as defined by commission rule. |
|
SECTION 2. This Act takes effect September 1, 2021. |
