A BILL TO BE ENTITLED
 
AN ACT
  relating to the recording of certain personal information of voters
  by election officials.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 63, Election Code, is amended by adding
  Section 63.0012 to read as follows:
         Sec. 63.0012.  RECORDED DOCUMENTATION OF CERTAIN PERSONAL
  INFORMATION. (a) An election officer may copy documentation
  presented by a voter under Section 63.001(b) or record information
  from the documentation.
         (b)  An election officer may photograph the entire face of a
  voter who is accepted for voting under this chapter if:
               (1)  the documentation presented by a voter under
  Section 63.001(b) is not documentation issued by the Department of
  Public Safety containing the person's photograph; or 
               (2)  the election official questions the authenticity
  of the documentation presented by a voter under Section 63.001(b),
  regardless of whether the documentation is issued by the Department
  of Public Safety and contains the person's photograph.
         (c)  A voter may only be photographed under this section
  while being accepted for voting and may not be photographed while
  the voter is occupying a voting station.
         (d)  Information copied or recorded under this section,
  including a photograph produced under Subsection (b), is
  confidential except for use in a criminal investigation or
  prosecution or a civil court proceeding.
         (e)  All information collected under this section shall be
  provided to the secretary of state for election-related purposes.
         SECTION 2.  This Act takes effect September 1, 2021.
