A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the preference given by state agencies for certain |
|
|
goods and services produced or offered by small businesses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 2155, Government Code, is |
|
|
amended by adding Section 2155.454 to read as follows: |
|
|
Sec. 2155.454. PREFERENCE FOR SMALL BUSINESS. (a) In this |
|
|
section, "small business" has the meaning assigned by Section |
|
|
2155.505. |
|
|
(b) Except as provided by Subsection (c), the comptroller |
|
|
and each state agency that enters into a contract for the purchase |
|
|
of goods or services with a value of less than $500,000 shall give |
|
|
preference to goods or services produced or offered by a small |
|
|
business. |
|
|
(c) This section does not apply to the purchase of |
|
|
telecommunications equipment, telecommunications service, |
|
|
advanced communications services, or information service, as those |
|
|
terms are defined by 47 U.S.C. Section 153. |
|
|
(d) The comptroller may adopt rules to implement this |
|
|
section. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a contract for the purchase of goods or services that is entered |
|
|
into on or after the effective date of this Act. A contract entered |
|
|
into before the effective date of this Act is governed by the law in |
|
|
effect on the date the contract was entered into, and the former law |
|
|
is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
