A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an application for a writ of habeas corpus in a |
|
|
community supervision case. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 5(a), Article 11.072, Code of Criminal |
|
|
Procedure, is amended to read as follows: |
|
|
(a) Immediately on filing an application, the applicant |
|
|
shall serve a copy of the application on the attorney representing |
|
|
the state[,] by: |
|
|
(1) [either] certified mail, return receipt |
|
|
requested; |
|
|
(2) [, or] personal service; or |
|
|
(3) secure electronic mail or another form of secure |
|
|
electronic transmission. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an application for a writ of habeas corpus filed on or after the |
|
|
effective date of this Act. An application filed before the |
|
|
effective date of this Act is governed by the law in effect when the |
|
|
application was filed, and the former law is continued in effect for |
|
|
that purpose. |

|
SECTION 3. This Act takes effect September 1, 2021. |
