A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain counties to restrict the use of |
|
|
engine braking. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 542, Transportation Code, |
|
|
is amended by adding Section 542.207 to read as follows: |
|
|
Sec. 542.207. ENGINE BRAKING RESTRICTIONS IN CERTAIN |
|
|
COUNTIES. The commissioners court of a county with a population of |
|
|
150,000 or more by order may prohibit or otherwise restrict in the |
|
|
unincorporated area of the county the use of engine braking. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
