A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to commercial signs along certain roads in certain |
|
|
counties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 391, Transportation Code, |
|
|
is amended by adding Section 391.2521 to read as follows: |
|
|
Sec. 391.2521. COUNTY APPROVAL FOR CERTAIN COMMERCIAL |
|
|
SIGNS. (a) The commissioners court of a county by order may |
|
|
require a person to obtain county approval for the construction or |
|
|
reconstruction of a commercial sign located: |
|
|
(1) in a county that contains more than one area that |
|
|
is certified as a Dark Sky Community by the International Dark-Sky |
|
|
Association as part of the International Dark Sky Places Program; |
|
|
and |
|
|
(2) adjacent to and visible from a farm-to-market or |
|
|
ranch-to-market road. |
|
|
(b) The department may not issue a permit under this chapter |
|
|
to an applicant who is required to obtain county approval under this |
|
|
section unless the person has obtained the required county |
|
|
approval. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
