A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of an providers right to redispense. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Section 1431.002, Health and |
|
Safety Code, is amended by adding a Subsection to read as follows: |
|
"Redispense" means to prepare or compound in the course of |
|
professional practice, a prescription drug or device for delivery |
|
to an ultimate user or the user's agent under a practitioner's |
|
lawful order, after the prescription or drug has been originally |
|
dispensed, but does not include relabeling; |
|
SECTION 2. Subchapter B, Section 1431.021, Health and |
|
Safety Code, Subdivision (w) is amended to read as follows: |
|
(w) except as provided under Subchapter M of this chapter |
|
and Section 562.1085, Occupations Code, the acceptance by a person |
|
of an unused prescription or drug, in whole or in part, for the |
|
purpose of resale or redispensing, after the prescription or drug |
|
has been originally dispensed, or sold; |
|
SECTION 3. This Act takes effect September 1, 2021. |
