A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of an providers right to redispense.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Section 1431.002, Health and
  Safety Code, is amended by adding a Subsection to read as follows:
         "Redispense" means to prepare or compound in the course of
  professional practice, a prescription drug or device for delivery
  to an ultimate user or the user's agent under a practitioner's
  lawful order, after the prescription or drug has been originally
  dispensed, but does not include relabeling;
         SECTION 2.  Subchapter B, Section 1431.021, Health and
  Safety Code, Subdivision (w) is amended to read as follows:
         (w)  except as provided under Subchapter M of this chapter
  and Section 562.1085, Occupations Code, the acceptance by a person
  of an unused prescription or drug, in whole or in part, for the
  purpose of resale or redispensing, after the prescription or drug
  has been originally dispensed, or sold;
         SECTION 3.  This Act takes effect September 1, 2021.
