A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of certain municipalities to impose a fee
  for water or sewer service to raise revenue for a municipally owned
  or operated animal shelter.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 552, Local Government
  Code, is amended by adding Section 552.915 to read as follows:
         Sec. 552.915.  FEE FOR WATER OR SEWER SERVICE IN CERTAIN
  MUNICIPALITIES. (a) This section applies only to a municipality
  with a population of less than 150,000.
         (b)  A municipality's authority under this section is in
  addition to authority granted by municipal charter.
         (c)  A utility that provides water or sewer service and is
  owned, operated, or controlled by a municipality may assess a fee
  for water or sewer service of not more than $1 per month for
  transfer under Subsection (d).
         (d)  The municipality that owns, operates, or controls the
  utility described by Subsection (c) may:
               (1)  transfer revenue from the fee authorized by
  Subsection (c) to the general fund of the municipality; and
               (2)  use the revenue for the purposes of an animal
  shelter, as defined by Section 823.001, Health and Safety Code,
  that is owned or operated by the municipality.
         SECTION 2.  This Act takes effect September 1, 2021.
