A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain municipalities to impose a fee |
|
|
for water or sewer service to raise revenue for a municipally owned |
|
|
or operated animal shelter. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 552, Local Government |
|
|
Code, is amended by adding Section 552.915 to read as follows: |
|
|
Sec. 552.915. FEE FOR WATER OR SEWER SERVICE IN CERTAIN |
|
|
MUNICIPALITIES. (a) This section applies only to a municipality |
|
|
with a population of less than 150,000. |
|
|
(b) A municipality's authority under this section is in |
|
|
addition to authority granted by municipal charter. |
|
|
(c) A utility that provides water or sewer service and is |
|
|
owned, operated, or controlled by a municipality may assess a fee |
|
|
for water or sewer service of not more than $1 per month for |
|
|
transfer under Subsection (d). |
|
|
(d) The municipality that owns, operates, or controls the |
|
|
utility described by Subsection (c) may: |
|
|
(1) transfer revenue from the fee authorized by |
|
|
Subsection (c) to the general fund of the municipality; and |
|
|
(2) use the revenue for the purposes of an animal |
|
|
shelter, as defined by Section 823.001, Health and Safety Code, |
|
|
that is owned or operated by the municipality. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
