A BILL TO BE ENTITLED
 
AN ACT
  relating to a study by the Texas Commission on Environmental
  Quality of air contaminants in residential areas in certain
  counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 382, Health and Safety
  Code, is amended by adding Section 382.0162 to read as follows:
         Sec. 382.0162.  ANNUAL POLLUTION STUDY IN CERTAIN COUNTIES.
  (a)  This section applies only to a county with a population of more
  than 800,000 in which a permanent concrete plant is located less
  than one mile from any building used as a single or multifamily
  residence in the unincorporated area of the county.
         (b)  The commission shall conduct an annual study of air
  contaminant levels in residential areas in the unincorporated area
  of a county that are located less than 500 feet from an industrial
  facility.
         (c)  The air contaminants studied must include those
  included on the air pollutant watch list described by Section
  382.0161. 
         (d)  The commission shall report the results of each study to
  the commissioners court of each county included in the study. 
         SECTION 2.  The Texas Commission on Environmental Quality
  shall begin the first study required by Section 382.0162, Health
  and Safety Code, as added by this Act, not later than December 1,
  2021.
         SECTION 3.  This Act takes effect September 1, 2021.
