A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice of contamination of a public water supply to |
|
|
certain water providers by the Texas Commission on Environmental |
|
|
Quality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
|
|
by adding Section 26.0395 to read as follows: |
|
|
Sec. 26.0395. NOTIFICATION OF CONTAMINATION THREATENING |
|
|
CERTAIN PUBLIC WATER SUPPLY SYSTEMS. As soon as possible after the |
|
|
commission detects or becomes aware of contamination of water that |
|
|
is a source for a public water supply and not later than the time the |
|
|
commission notifies the news media of the contamination, the |
|
|
commission shall give notice of the contamination to the owner or |
|
|
operator of each public water supply system that may be affected by |
|
|
the contamination. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
