A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the membership of the Public Utility Commission of |
|
Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 12.051, Utilities Code, is amended to |
|
read as follows: |
|
Section 12.051. APPOINTMENT; TERM. (a) The commission is |
|
composed of five [three] commissioners appointed by the governor |
|
with the advice and consent of the senate. |
|
(b) The members shall be appointed to reflect the diverse |
|
geographic regions and population groups of the state. One member |
|
must reside in a rural area and be a registered voter of a county |
|
with a population of less than 150,000. |
|
(c) [(b)] An appointment to the commission shall be made |
|
without regard to the race, color, disability, sex, religion, age, |
|
or national origin of the appointee. |
|
(d) [(c)] Commissioners serve staggered, six-year terms, |
|
with the terms of one or two members expiring every two years. |
|
SECTION 2. Promptly after this Act takes effect, the |
|
governor shall appoint two additional members to the Public Utility |
|
Commission of Texas. Of those members, the governor shall |
|
designate one to serve a term expiring September 1, 2025, and one to |
|
serve a term expiring September 1, 2027. |
|
SECTION 3. This Act takes effect September 1, 2021. |
