A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the creation of the criminal offense of a peace officer |
|
|
making a false statement in an incident report. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 39, Penal Code, is amended by adding |
|
|
Section 39.08 to read as follows: |
|
|
Sec. 39.08. FALSE STATEMENT IN INCIDENT REPORT. (a) A |
|
|
peace officer commits an offense if the officer: |
|
|
(1) files a report with the law enforcement agency |
|
|
employing the officer regarding the commission or investigation of |
|
|
an offense; and |
|
|
(2) intentionally or knowingly makes a false statement |
|
|
in the report. |
|
|
(b) An offense under this section is a Class A misdemeanor. |
|
|
(c) It is an exception to the application of this section |
|
|
that the peace officer attributes the false statement to another |
|
|
person in the report. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
