A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to rolling blackouts. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 38, Utilities Code, is |
|
amended by adding Section 38.074 to read as follows: |
|
Sec. 38.074. ROLLING BLACKOUTS. The commission by rule |
|
shall require each electric utility, municipally owned utility, and |
|
electric cooperative that is subject to a rolling blackout |
|
initiated by an independent organization certified under Section |
|
39.151 to rotate customer curtailment so that no customer is |
|
subject to an outage of more than 12 hours. |
|
SECTION 2. (a) The Public Utility Commission of Texas shall |
|
conduct a study on: |
|
(1) methods to make the imposition of a rolling |
|
blackout equitable across the state; and |
|
(2) measures needed in this state to prevent the |
|
necessity of rolling blackouts. |
|
(b) Not later than September 1, 2022, the Public Utility |
|
Commission of Texas shall submit to the legislature a report on the |
|
results of the study. |

SECTION 3. This Act takes effect September 1, 2021. |
