A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain counties to use an alternate |
|
|
work period for county peace officers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 157.021, Local Government Code, is |
|
|
amended by adding Subsection (c) to read as follows: |
|
|
(c) This section does not limit the authority of the |
|
|
commissioners court of a county to adopt or enforce a work period of |
|
|
up to 28 days for peace officers employed by the county in |
|
|
accordance with the federal Fair Labor Standards Act of 1938 (29 |
|
|
U.S.C. Section 207). |

|
SECTION 2. Section 157.022, Local Government Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) This section does not apply to a peace officer |
|
|
commissioned by a county that has adopted a work period of longer |
|
|
than seven days for those peace officers in accordance with the |
|
|
federal Fair Labor Standards Act of 1938 (29 U.S.C. Section 207). |

SECTION 3. This Act takes effect September 1, 2021. |
