A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to businesses' civil liability for COVID-19 exposure. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Title 4, Civil Practice and Remedies Code, is |
|
|
amended by adding Chapter 100C to read as follows: |
|
|
CHAPTER 100C. COVID-19 EXPOSURE LIABILITY FOR BUSINESSES |
|
|
Sec. 100C.001. LIABILITY LIMITED. A business entity or |
|
|
person who owns a business entity may not be held liable for injury |
|
|
or death caused by exposure to the 2019 novel coronavirus disease |
|
|
that occurred due to the entity's activities or operations, unless |
|
|
a claimant proves that the exposure was caused by gross negligence |
|
|
or wilful misconduct. |
|
|
SECTION 2. Chapter 100C, Civil Practice and Remedies Code, |
|
|
as added by this Act, applies to a cause of action that accrued |
|
|
before, on, or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
