A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to annulment of a marriage on the grounds of fraud, duress, |
|
or force. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 6.107, Family Code, is amended to read as |
|
follows: |
|
Sec. 6.107. FRAUD, DURESS, OR FORCE. The court may grant an |
|
annulment of a marriage to a party to the marriage if: |
|
(1) the other party used fraud, duress, or force to |
|
induce the petitioner to enter into the marriage; and |
|
(2) the petitioner ceased cohabitation with the other |
|
party not more than one year after the petitioner learned of the |
|
fraud or was released from the duress or force and has not |
|
voluntarily cohabited with the other party since ceasing |
|
cohabitation [learning of the fraud or since being released from |
|
the duress or force]. |
|
SECTION 2. The change in law made by this Act applies only |
|
to a suit for dissolution of a marriage that is filed on or after the |
|
effective date of this Act. A suit for dissolution of a marriage |
|
filed before the effective date of this Act is governed by the law |
|
in effect on the date the suit was filed, and the former law is |
|
continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2021. |
