A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to prohibited billing practices by certain health care |
|
providers. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Sections 311.0025(a) and (b), Health and Safety |
|
Code, are amended to read as follows: |
|
(a) A hospital, treatment facility, mental health facility, |
|
or health care professional may not: |
|
(1) flagrantly overcharge a patient or third party |
|
payor for a treatment provided to the patient; or |
|
(2) submit to a patient or a third party payor a bill |
|
for a treatment that the hospital, facility, or professional knows |
|
was not provided or knows was improper, unreasonable, or medically |
|
or clinically unnecessary. |
|
(b) If the appropriate licensing agency receives a |
|
complaint alleging a violation of Subsection (a)(2) [(a)], the |
|
agency may audit the billings and patient records of the hospital, |
|
treatment facility, mental health facility, or health care |
|
professional. |
|
SECTION 2. This Act takes effect September 1, 2021. |
