A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a temporary abatement of evictions for failure to pay |
|
|
rent during and after a disaster. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 24, Property Code, is amended by adding |
|
|
Section 24.012 to read as follows: |
|
|
Sec. 24.012. TEMPORARY ABATEMENT OF EVICTION DURING AND |
|
|
AFTER DISASTER. (a) In this section, "state of disaster" means a |
|
|
state of disaster declared by the governor under Section 418.014, |
|
|
Government Code. |
|
|
(b) This section applies only to an eviction based on a |
|
|
tenant's nonpayment of rent. |
|
|
(c) An action under this chapter to evict a tenant is |
|
|
automatically abated without a court order during the period a |
|
|
state of disaster is in effect and until the 61st day after the date |
|
|
a state of disaster ends. |
|
|
(d) During the period a state of disaster is in effect and |
|
|
until the 61st day after the date a state of disaster ends, an |
|
|
officer may not execute a writ of possession relating to the |
|
|
eviction of a tenant. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
