A BILL TO BE ENTITLED
 
AN ACT
  relating to a temporary abatement of evictions for failure to pay
  rent during and after a disaster.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 24, Property Code, is amended by adding
  Section 24.012 to read as follows:
         Sec. 24.012.  TEMPORARY ABATEMENT OF EVICTION DURING AND
  AFTER DISASTER. (a) In this section, "state of disaster" means a
  state of disaster declared by the governor under Section 418.014,
  Government Code.
         (b)  This section applies only to an eviction based on a
  tenant's nonpayment of rent.
         (c)  An action under this chapter to evict a tenant is
  automatically abated without a court order during the period a
  state of disaster is in effect and until the 61st day after the date
  a state of disaster ends.
         (d)  During the period a state of disaster is in effect and
  until the 61st day after the date a state of disaster ends, an
  officer may not execute a writ of possession relating to the
  eviction of a tenant.
         SECTION 2.  This Act takes effect September 1, 2021.
