A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to unemployment compensation chargebacks regarding |
|
certain persons employed as seasonal employees. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 204.022, Labor Code, is amended by |
|
adding Subsection (a-3) to read as follows: |
|
(a-3) Benefits computed on benefit wage credits of a |
|
seasonal employee or former seasonal employee may not be charged to |
|
the account of an employer if at least 75 percent of the employees |
|
employed by the employer during each of the most recent three |
|
calendar years were employed as seasonal employees. In this |
|
subsection, "seasonal employee" means an employee who, as a regular |
|
course of the employee's conduct, engages in seasonal or cyclical |
|
employment that does not continue throughout the entire year. |
|
SECTION 2. The change in law made by this Act applies only |
|
to a claim for unemployment compensation benefits filed with the |
|
Texas Workforce Commission on or after the effective date of this |
|
Act. A claim filed before the effective date of this Act is |
|
governed by the law in effect on the date the claim was filed, and |
|
the former law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect October 1, 2021. |
