A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to prohibiting urination or defecation in certain public |
|
|
places; creating a criminal offense. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 48, Penal Code, is amended by adding |
|
|
Section 48.05 to read as follows: |
|
|
Sec. 48.05. PROHIBITION ON URINATING OR DEFECATING IN |
|
|
PUBLIC PLACE. (a) A person commits an offense if the person |
|
|
intentionally or knowingly urinates or defecates in a public place, |
|
|
other than a public restroom. |
|
|
(b) An offense under this section is a Class B misdemeanor. |
|
|
(c) If conduct that constitutes an offense under this |
|
|
section also constitutes an offense under another law, the actor |
|
|
may be prosecuted under this section, the other law, or both. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
