A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to authorizing the online ordering and purchasing of |
|
|
alcoholic beverages. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 102, Alcoholic Beverage |
|
|
Code, is amended by adding Section 102.23 to read as follows: |
|
|
Sec. 102.23. INTERNET PURCHASES AND ORDERS AUTHORIZED. (a) |
|
|
Subject to the limitations of this subchapter, Subchapter B, and |
|
|
other applicable provisions of this code, any purchase or order |
|
|
that is authorized by this code to be made by a distributor from a |
|
|
manufacturer, by a retailer from a distributor, or by an ultimate |
|
|
consumer from a retailer may be made through an Internet website. |
|
|
(b) The commission by rule shall establish measures to |
|
|
ensure that Internet purchases authorized under this section comply |
|
|
with any requirements regarding age and other applicable provisions |
|
|
of this code. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
