A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the prohibition of glyphosate herbicides on the grounds |
|
|
of a public or private school or institution of higher education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 76.101, Agriculture Code, is amended by |
|
|
adding Subsection (e) to read as follows: |
|
|
(e) The department, by appropriate means under this |
|
|
chapter, shall prohibit the application of a herbicide containing |
|
|
glyphosate on the grounds of a public or private school or |
|
|
institution of higher education. The department may allow the |
|
|
application of a herbicide containing glyphosate on the grounds of |
|
|
a high school or institution of higher education only for the |
|
|
purpose of producing a crop as part of an agriculture curriculum or |
|
|
agricultural research. |
|
|
SECTION 2. The Department of Agriculture shall implement |
|
|
Section 76.101(e), Agriculture Code, as added by this Act, not |
|
|
later than the 90th day after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
