A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to prohibiting the arrest of a person for a violation of a |
|
|
condition of community supervision based on certain drug test |
|
|
results. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 42A.751, Code of Criminal Procedure, is |
|
|
amended by adding Subsection (b-1) to read as follows: |
|
|
(b-1) Notwithstanding Subsection (b), the judge may not |
|
|
issue a warrant for a violation of a condition of community |
|
|
supervision solely because the results of a drug test taken by the |
|
|
defendant indicated that tetrahydrocannabinol or cannabidiol was |
|
|
present in the body of the defendant. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
