A BILL TO BE ENTITLED
 
AN ACT
  relating to prohibiting the arrest of a person for a violation of a
  condition of community supervision based on certain drug test
  results.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article 42A.751, Code of Criminal Procedure, is
  amended by adding Subsection (b-1) to read as follows:
         (b-1)  Notwithstanding Subsection (b), the judge may not
  issue a warrant for a violation of a condition of community
  supervision solely because the results of a drug test taken by the
  defendant indicated that tetrahydrocannabinol or cannabidiol was
  present in the body of the defendant.
         SECTION 2.  This Act takes effect September 1, 2021.
