A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to certain employment and occupational licensing |
|
restrictions based on a person's prior conviction. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 22.092, Education Code, is amended by |
|
adding Subsection (c-1) to read as follows: |
|
(c-1) Notwithstanding any other law, a person is not |
|
ineligible for employment in a public school as a food service |
|
worker solely because the person has been convicted of a |
|
nonviolent, nonsexual offense. |
|
SECTION 2. Subchapter B, Chapter 53, Occupations Code, is |
|
amended by adding Section 53.027 to read as follows: |
|
Sec. 53.027. ELIGIBILITY FOR CERTAIN LICENSES. (a) This |
|
section applies only to a license issued under: |
|
(1) Title 3; |
|
(2) Title 7; |
|
(3) Title 8; or |
|
(4) Title 12. |
|
(b) Notwithstanding any other law, an applicant may not be |
|
denied a license to which this section applies based solely on the |
|
applicant having been convicted of a nonviolent, nonsexual offense. |
|
SECTION 3. Section 522.081, Transportation Code, is amended |
|
by adding Subsection (i) to read as follows: |
|
(i) Notwithstanding any other law, a person may not be |
|
disqualified from driving a commercial motor vehicle based solely |
|
on the person having been convicted of a nonviolent, nonsexual |
|
offense. |

SECTION 4. This Act takes effect September 1, 2021. |
