A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the failure of a property owners' association to file |
|
|
all dedicatory instruments of a residential subdivision as public |
|
|
records. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 202.006, Property Code, is amended by |
|
|
adding Subsection (c) to read as follows: |
|
|
(c) A property owners' association may not collect a regular |
|
|
assessment, as defined by Section 209.002, if the dedicatory |
|
|
instruments are not filed as required by Subsection (a). |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
