A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a landlord's duty to inspect for and treat bedbugs in |
|
|
residential rental units. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 92, Property Code, is |
|
|
amended by adding Section 92.0521 to read as follows: |
|
|
Sec. 92.0521. LANDLORD'S DUTY TO INSPECT FOR AND TREAT |
|
|
BEDBUGS; DISCLOSURE. (a) Except as provided by Subsection (b), |
|
|
during a tenant's lease term or during a renewal or extension, the |
|
|
landlord has a duty to inspect and treat, at the landlord's expense, |
|
|
the leased premises for bedbugs. |
|
|
(b) A tenant may decline in writing the landlord's |
|
|
inspection for and treatment of bedbugs under Subsection (a). |
|
|
(c) A provision stating the landlord's duty under this |
|
|
section must be included in a lease agreement signed by the tenant. |
|
|
SECTION 2. Section 92.0521, Property Code, as added by this |
|
|
Act, applies only to a lease entered into or renewed on or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
