A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the authority of a municipality to collect a records |
|
|
management and preservation fee. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subtitle A, Title 4, Local Government Code, is |
|
|
amended by adding Chapter 109 to read as follows: |
|
|
CHAPTER 109. FEES CHARGED BY MUNICIPALITIES |
|
|
Sec. 109.001. RECORDS MANAGEMENT AND PRESERVATION FEE. (a) |
|
|
A municipality may collect a records management and preservation |
|
|
fee not to exceed $1 for any municipal authorization, permit, |
|
|
license, registration, certification, filing, or other municipal |
|
|
action or approval. |
|
|
(b) The records management and preservation fee must be |
|
|
deposited in a separate records management and preservation account |
|
|
in the general fund of the municipality. |
|
|
(c) The records management and preservation fee may be used |
|
|
only to provide funds for specific records management and |
|
|
preservation, including municipal library and archival services. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
