A BILL TO BE ENTITLED
 
AN ACT
  relating to the adoption by the Railroad Commission of Texas of a
  permit by rule for the beneficial reuse of domestic wastewater and
  mobile drinking water treatment system wastewater produced at
  certain oil and gas drilling sites.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle D, Title 3, Natural Resources Code, is
  amended by adding Chapter 124 to read as follows:
  CHAPTER 124. TREATMENT AND RECYCLING FOR BENEFICIAL USE OF CERTAIN
  WASTEWATER AT OIL AND GAS DRILLING SITES
         Sec. 124.001.  DEFINITIONS. In this chapter: 
               (1)  "Commission" means the Railroad Commission of
  Texas.
               (2)  "Domestic wastewater" means wastewater that
  originates primarily from kitchen, bathroom, and laundry sources,
  including waste from food preparation, dishwashing, garbage
  grinding, toilets, baths, showers, and sinks of a residential
  dwelling.
               (3)  "Mobile drinking water treatment system
  wastewater" means wastewater generated from the treatment of
  surface or subsurface groundwater for drinking water purposes.
         Sec. 124.002.  BENEFICIAL RECYCLING OF CERTAIN WASTEWATER AT
  OIL AND GAS DRILLING SITES. (a) This section applies to an oil and
  gas drilling site regardless of whether the well has been
  completed.
         (b)  The commission shall adopt a permit by rule for the
  beneficial recycling of:
               (1)  treated domestic wastewater generated at oil and
  gas drilling sites; and
               (2)  mobile drinking water treatment system
  wastewater, including reverse osmosis reject water, generated from
  oil and gas drilling sites.
         (c)  The commission, in adopting a permit by rule under this
  section, must require:
               (1)  that discharges of treated wastewater at oil and
  gas drilling sites are in compliance with the state's applicable
  water quality standards for reuse down-hole or applied to land;
               (2)  notification of the start date and exact location
  for each domestic wastewater or mobile drinking water treatment
  system unit;
               (3)  reporting requirements that include:
                     (A)  the total number of days domestic wastewater
  or mobile drinking water treatment system wastewater is reused or
  applied after treatment; 
                     (B)  the total volume of each type of wastewater
  received for treatment; 
                     (C)  the total volume of treated effluent for each
  type of reuse method, including down-hole, controlled irrigation,
  and dust suppression;
                     (D)  a table of the water treatment analytical
  results, sampling dates, corresponding analytical reports, and
  chain of custody for the parameters; and 
                     (E)  the filing of an organization report; and
               (4)  financial security assurances in an amount not to
  exceed $200,000 per year for each active permit.
         SECTION 2.  Not later than December 1, 2021, the Railroad
  Commission of Texas shall adopt the permit by rule as required by
  Section 124.002, Natural Resources Code, as added by this Act.
         SECTION 3.  This Act takes effect September 1, 2021.
