A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to providing a list of approved devices to defendants |
|
|
restricted to the operation of a vehicle equipped with an ignition |
|
|
interlock device as a condition of community supervision. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 42A.408, Code of Criminal Procedure, is |
|
|
amended by adding Subsection (i) to read as follows: |
|
|
(i) A defendant ordered to install an interlock device as a |
|
|
condition of community supervision shall have the ability to choose |
|
|
from among any interlock provider approved by the Department of |
|
|
Public Safety as provided by subsection (g) of this section. |
|
|
SECTION 2. The Department of Public Safety shall publish a |
|
|
list of approved ignition interlock devices as required by Article |
|
|
42A.408(g-1), Code of Criminal Procedure, as added by this Act, not |
|
|
later than December 1, 2021. |
|
|
SECTION 3. The change in law made by this Act applies only |
|
|
to a defendant placed on community supervision on or after January |
|
|
23 1, 2021. |
|
|
SECTION 4. This Act takes effect September 1, 2021. |
