A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the requirement for certain persons to provide |
|
information to a peace officer; creating a criminal offense. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article 2.13, Code of Criminal Procedure is |
|
amended by adding Subsection (g) to read as follows: |
|
(g) If an officer has lawfully arrested or detained a |
|
person, or has good cause to believe that a person is a witness to a |
|
criminal offense, the officer may request that the person provide |
|
the officer with the person's name, residence address, and date of |
|
birth, and the person may not refuse to provide the requested |
|
information to the officer. A person who refuses to give to an |
|
officer information requested under this subsection commits an |
|
offense under Section 38.02, Penal Code. Each law enforcement |
|
agency shall adopt a written policy regarding the collection of |
|
information under this subsection. |

SECTION 2. This Act takes effect September 1, 2021. |
