A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of the Public Utility Commission of Texas
  to set wholesale electricity prices in the ERCOT power region
  during a state of disaster.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.151, Utilities Code, is amended by
  adding Subsection (d-5) to read as follows:
         (d-5)  Notwithstanding Subsection (d), during a state of
  disaster declared by the governor under Chapter 418, Government
  Code, in response to an extreme weather event, the commission may
  not by order raise the wholesale price of electric energy sold in
  the ERCOT power region for the purpose of correcting the price of
  electric energy to match the demand for electric energy.
         SECTION 2.  This Act takes effect September 1, 2021.
