A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment protecting an individual's |
|
|
right to earn a living free from unnecessary governmental |
|
|
interference. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article I, Texas Constitution, is amended by |
|
|
adding Section 35 to read as follows: |
|
|
Sec. 35. (a) An individual has the right to engage in a |
|
|
lawful occupation or profession free from unnecessary regulation. |
|
|
(b) This state or a political subdivision of this state may |
|
|
not enact or enforce a regulation that imposes a substantial burden |
|
|
on an individual's right to engage in a lawful occupation or |
|
|
profession unless the regulation is necessary and narrowly tailored |
|
|
to protect against actual and specific harm to the public's health |
|
|
and safety. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held on November 2, |
|
|
2021. The ballot shall be printed to permit voting for or against |
|
|
the proposition: "The constitutional amendment protecting an |
|
|
individual's right to earn a living free from unnecessary |
|
|
governmental interference." |
